TRUXX App Terms and Conditions

Welcome to TRUXX App!
These terms and conditions (“Terms”) govern your use of the TRUXX App and its associated services (collectively referred to as the “App”). Please read these Terms carefully before accessing or using the App. By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the App.
User Accounts:
a. To access certain features of the App, you may be required to create a user account. You must provide accurate and complete information during the registration process, such as First name and Last name, Phone Number, Email, and digital Payment Details.
b. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
c. You agree to notify TRUXX App immediately of any unauthorized use of your account or any other breach of security.
App Usage and Limitations:
a. The App is intended for the purpose of connecting customers with truck drivers to facilitate transportation services, and act as an enabler of trade growth. Any other use of the App is strictly prohibited.
b. You agree not to engage in any illegal, unauthorized, or prohibited activities while using the App, you hold the responsibility of nature of goods transported with no legal responsibility on TRUXX TRANSPORTATION TECHNOLOGY LLC on the nature of goods loaded using the TRUXX App.
c. TRUXX App reserves the right to suspend or terminate your access to the App, without prior notice, for any violation of these Terms.
Transportation Services:
a. TRUXX App acts as a platform or a marketplace to connect customers with truck drivers. We are not obligated to provide transportation services directly to customers, unless a direct contract is forged between you and TRUXX TRANSPORTATION TECHNOLOGY LLC.
b. TRUXX App does not guarantee the availability, or reliability of transportation services provided by drivers. Users are advised to choose the suitable truck size, and advised to also exercise due diligence and use their discretion when engaging with drivers.
c. TRUXX App is not liable for any loss, damage, or harm arising from interactions or transactions between users.
Payments and Fees:
a. The pricing for transportation services will be communicated to customers through the app, the app will show a price range for each transportation trip. The app will not show you a fixed rate due to the possibility of circumstances may occurs such as Traffic jams, Fuel Rate Variations, Toll Gates, among other reasons that is out of the app control, Customers are responsible for payment range of the agreed-upon transportation parameters.
b. TRUXX App may collect payments on behalf of the drivers. Payments made by customers will be transferred to the drivers after deducting applicable taxes, fees, and commissions.
c. TRUXX Co. is customer-centric services company. Any disputes regarding payments or fees should be resolved directly between customers and drivers. TRUXX App is not responsible for resolving such disputes, but will play a mediator and a facilitator role to ensure smooth transportation experience.
Intellectual Property:
a. All intellectual property rights, including but not limited to trademarks, logos, and content, belong to TRUXX App. You may not use or reproduce any intellectual property without prior written consent.
b. By submitting any content to the App, you grant TRUXX App a non-exclusive, royalty-free, worldwide license to use, display, reproduce, modify, and distribute the content for the purposes of operating and promoting the App.
Privacy Policy:
a. TRUXX App collects and processes personal information in accordance with its Privacy Policy. By using the App, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.
Modifications and Termination:
a. TRUXX App reserves the right to modify, suspend, or terminate the App or any part thereof, at any time and without prior notice.
b. TRUXX App may also modify these Terms at its discretion. Changes will be effective immediately upon posting. It is your responsibility to review the Terms periodically for any updates.
Governing Law and Dispute Resolution:
a. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where TRUXX App is based.
b. Any disputes arising out of or in connection with these Terms shall be resolved through amicable negotiations. If a resolution cannot be reached, the disputes shall be submitted to the competent courts of the jurisdiction.
Severability:
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
